Terms of Sale

Roboporium is an affiliated subsidiary of KumoTek, LLC of Lewisville, Texas, USA. For the purposes of these terms of sale, Roboporium will henceforth be referred to as KumoTek. By purchasing an item through KumoTek, the purchaser agrees to the terms and conditions set forth herein. Products: KumoTek's store policy is progessive in nature, and strives to continually update all products and software as new revisions come out. KumoTek may revise and discontinue products at any time. KumoTek will ship products that have the functionality and performance of the products ordered, but changes between what is shipped and what is described in a specification sheet or catalog are possible. Payment Terms; Orders; Quotes; Interest: Terms of payment are within KumoTek's sole discretion, and unless otherwise agreed to by KumoTek, payment must be received by KumoTek prior to KumoTek's acceptance of an order. Payment for the products will be made by credit card, wire transfer, or some other prearranged payment method. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. KumoTek may invoice parts of an order separately. Orders are not binding upon KumoTek until accepted by KumoTek. Any quotations given by KumoTek will be valid for the period stated on the quotation. Customer agrees to pay interest on all past-due sums at the highest rate allowed by U.S. Law. Returns: All sales are final unless the item is proven to be defective. Robots that are defective will be replaced or repaired by the manufacturer. Customer will be liable for shipping the defective parts to the manufacturer for replacement or repair. There will be a slight re-boxing fee for products not returned in the original manufacturer's packaging. CUSTOMER AGREES TO RESOLVE PAYMENT ISSUES AND CONFLICTS WITH KUMOTEK. Discounts and Promotions: Discount rate does not apply to items that are currently discounted or marked as on "sale". If promotionary discount is currently in effect, items marked on sale have already been disounted in addition to the special promotion. Taxes: Unless otherwise stated on the face hereof, stated prices do not include any customs duties, sales, use, value added, excise, federal, state, local or other taxes. All such duties or taxes shall be paid by customer, or, in lieu thereof, customer shall provide Seller with an appropriate tax exemption certificate. Intellectual Property: The customer is in no way permitted to modify, sell, or alter names, logos or otherwise copyrighted, trademarked or patented identities. The user also agrees to abide by international copyright and intellectual property laws. Service and Support: KumoTek strives to provide the best customer service in the industry. We will strive to reply to all emails or phone calls within one business day. Once a purcahse has been made, KumoTek will provide free email support, and fee based consultations for onsite visits. These provisions are subject to change by KumoTek. Disputes: User agrees to release KumoTek and their affiliates from any and all liability that may arise from the improper or negligent use of KumoTek's products. KumoTek will not be liable for lost profits, loss of business, or other consequential, special, indirect or punitive damages, eben if advised of the possibilities of such damages, or for any claim filed by a third part. Puchaser agreed to settle any disputes arising between the purchaser, or user, and KumoTek in the State of Texas, or by a third party mediator agreed to by KumoTek.
